물권법의 강의를 듣는 자네가 "교수님의 강의를 듣고 있다보면 정말 법학이란
학문이 잼잇게 느껴지고 한번 푹 빠져서 공부해보고 싶은 학문이란 생각이 드네
요...^^"라고 한 말은
이나라 대학의 법학도들의 극 소수가 느낄수 있는 표현이거나 거의 대부분의 학
생들이 할 수 없는 생각을,아니 법학과를 나왔거나 다니는 법과생들의 그 아누
구도 감히 생각해 볼 수도 없는 법학에 대한 재미있는 방법론을 발견한 것일지
도 모른다네
우리 나라 대학의 법과생들의 대부분은 한번쯤은 현행의 사법시험과목속에 들
어 있는 법조문의 해석을 교과서등을 통해서 이해하여 사법시험합격에 큰 목적
을 두는 경우가 대부분이므로,단지 사법시험 합격방법론에 몰입하지 않을 수 없
어서,결국은 법조문을 객관적으로 합리적으로 논리적으로 풀이한 현행 실정법
의 해석학적의 이해와 암기과 합격 답안작성의 실력을 높이는 것이 주목적이므
로,재미있는 학문으로 한 번 푹 빠져서 공부해보고 싶다니...진짜 법학방법론
을 자네는 발견한 것이라네.
아니 사법시험 합격자를 많이내는 대학일 수록 상상을 할 수도 없는 법학방법론
을 넓히는, 보완하는 우리공동체의 법치주의 문화의 국제경쟁력을 높일 소중한,
온 국민들의 삶을 법으로 구제할 방법론을 자네가 알게 되어 스스로 말하는 것
이라네...
우리 공동체의 법문화를 발전시키고 국제경쟁력을 높힐려면,누가 어떤 법을 어
떻게 만들어 놓든,해석만 논리적이고 객관적이고 합리적으로 하면,법치주의국가
의 국제경쟁력이 생기고,잘살게 될것이라고 다들 그렇게 알고 믿고 살고 있다
네...
국제경쟁력있는 법을 만들어야 하고 시대에 맞지 않는 법을 시급히 잘 고쳐야
하고,이를 국력강화와 국민들이 삶의 질의 향상을 위해 현실에 맞게 해석해야
하고,이를 공정하게 의지를 가지고 잘 집행해야 국제경쟁력있는 잘 사는 법치주
의 국가가 될 것이라네...
그런데 우리나라의 대학에서 어느 법과에서 사법시험을 목표로한 법해석학적 방
법이외에 국제경쟁력있는 법을 만들어야 된다며,국민들의 삶의 질의 저하시키
는 법령,자치법을 시급히 잘 고쳐야 한다는 입법이론을 강의해주는 곳이 없다
네.
왜냐하면,법과대학에서는 사법시험 합격만 많이 시키면 그것으로 법학의 목적
과 법과대학의 목적이 끝난줄로 착각하고 만족하고 살아온 셈이라네.그래서 사
시합격이외의 법학방법론은 생각할수도 꿈도 꿀수도 없는 수험법학을 50여년간
해 왔고 앞으로도 별 변화가 없다면,그렇게 갈려고 할 것이라네...
이나라에서 해방후 지금껏 만들어 지고 고쳐지고 있는 8만여종의 법령.조례.규
칙들은 국민들도 그 법령의 내용은 고사하고 그 이름도 잘모르는 사이에 국회의
원들이나 행정부 공무원들이나 자치단체의 입법권자들의 손에 의해 수많은 변화
를 하고 있지만.그 법령,자치법규들이 정말 국제경쟁력이 나게 우리 공동체
에 알맞게 만들어 진것인지...만들어 지도록 심혈을 기울렸다고 생각할 수 있
는 법이 8만여 종류중에 과연 몇%나 될른지...
아니 우리에게 맞지않고 생활비만 많이들고,불편하고 나라와 사회와 국민들의
국제경쟁력을 떨어뜨리는 법조문은 몇개나 만들어 졌으며...왜 만들어지고,왜
시급히 고쳐지지 않는 것인지...이를 시급히 해결하고 대안이나 이론을 제시할
법이론이 우리공동체에서는 존재하지 않거나.존재하도록 꿈도 꾸지 않고 있는
자유민주 복지를 향한 대한민국이라는 법치주의 국가라네.
이렇게 만들어진 법은 우리국민 4천5백만 한사람 한사람에게 평생 태어나서 죽
을때까지 함께 그림자 처럼 따라다니며,부모님의 말씀보다 더 강하게,마피아나
폭력집단의 위력보다 더 강하게,군대보다 더 강하게 시시각각 우리들의 삶의 구
석구석을 현실적으로 지배하고 강제하고 온 인생전체를 억누르며 생각과 행동
을 합법적이지 않으면 위법하여 형벌이나 재산적 피해를 받게 해 가고 있다네.
비전문가들이나 대충.얼렁뚱땅 경쟁력없는 우리들의 삶의 발목을 잡는 불합리
하거나 경쟁력을 죽이는 삶의 질을 낮추는 짜증나는 법조문들이,입법권한을 가
진자의 민주적인 절차(합법적.다수결)에 의했다는 형식논리에 우리는 눈이 어두
워 그냥 금과옥조로 지켜야 한다고만 생각하고 복종하지 않을 수가 없는 법치
주의국가라네...
그 먼 미국이나 독일이나 프랑스나 선진외국의 법이론이나 그들의 수백년 천년
도 넘는 법역사를 예를들필요 없이,이땅위에서 한 나라를 세워서 500여년간이
나 법치주의 문화를 꽃피운 우리 조상들이 삶을 조선왕조실록을 통해서 살펴보
면,법은 백성들에게 불편하지 않고 백성들이 잘 살수 있게 하기 위해서 시대
와 환경에 맞는 이상적이 자손만대로 오래갈 법을 만들어야 한다는 이론이 입법
이론의 가장 중요한 많이 주장한 이론으로00여년간 법을 만들고 고쳤다고 실록
에 기록되어 있다면...(사법행정에 발표하였음)
우리는 오늘날 찬반양론이 팽팽한 국민들의 민원과 고통과 삶의 질을 낮추고 짜
증나게 하고 결국은 국가의재정과 국민들의 생활비를 더 낭비시키며 국가경쟁력
을 떨어뜨릴 법이라도,아니 전 국민들의 삶의 불편하고 인간다운 삶과 행복추구
권에서 더 멀어져가고,실질 소득이 더 감소되고,국력이 낭비되더라도,무조건 과
반수면 민주적이고,합법적이고 정의라며, 반대의사보다 한 명만 더 찬성하면 통
과된다라는 법이론이 과연 우리조상들에 입법이론에 부끄럼이 없는,진정으로 백
성들을 잘살게 하고 지키기 편리한 민주적인 법이라고 부끄럼없이 말 할 수 있
겠는지...
급하다고 얼렁뚱땅 보기좋게 수입하여 편집하고 짜집기하고,비전문가들의 오래
고 깊은 연구와 현실적인 현장조사도 없이 ,주마간산 식으로 만들고 고치기 시
작한다면...
그 법도 과반수 찬성이란 형식적인 숫자놀이로 실은 입법권자라는 주권을 위임
받는 입법권자의 국민의 신뢰를 배신한 행위로 만든 법이라도 민주주의 국가의
국민이 만든법이라며 스스로 지켜야 하는 우리네의 민주주의 국가의 입법이론
이 아닌지...
우리나라에서 법학이라는 학문은 대학에서는 사법시험합격에 눈이 어두워 시험
과목 해석과 답안작성 수준에만 정신이 다빼앗기는 사이에... 이런 불편함과 법
치주의 국가의 발전을 저하할수 있는 국제경쟁력없는 법을 마구잡이로 즉흥적으
로 몇몇이 비전문가들이,입법권을 위임받는 권한을 행사한다면... 적당히 만들
어 나가거나 고쳐 나간다면...아니 잘못된 시대에 맞지않는 법이 시급해 고쳐지
지 않는다면,,,아니 개선이 되기보다 개악이 되는 경우도 생긴다면...
우리는 언제 국제경쟁력있는 잘사는 나라나 국민들이 될수 있겠는지...그동안
의 숱한 정신적 물질적 삶의 질의 저하와 국력이 약화되고 개인의 삶이 찌들어
가는 인간다운 삶이 ,자유.민주.복지의 공동체는 언제 만들어 질른지..
그리고 모신문사에서는 법과를 평가한다면서 결국은 사법시험 합격자를 많이
배출한 법학과가 가장 좋은 법과로 평가를 하고 있다면...이나라에서 법학이란
학문이나,대학의 법학과가 할 수 있는 것이란 사법시험 합격을 위한 것 이외
는 더 연구할 필요가 더 무엇이 있겠는지...
IMF예방법이나 극복법이 신속히 잘 만들어 지지 않는데는 법학이 전혀 무관하다
면..이나라가 법치주의로 민주주의로 복지국가로 어떻게 나갈 수 있는지...
그리고 법으로 4,500만 나라의 주인의 삶을 온통 평생 좌지우지 하면서도, 국제
경쟁력있는 우리에게 알맞는 이상적인 법이 신속이 잘만들어 지거나 신속히 잘
고쳐지는데 이나라의 법과대학이 무관심하거나,이론제시를 못하거나,가르쳐 주
지않는다면...이나라 주인들은 어디에서 경쟁력있는 입법이론을 배울것인지...
아니 국민의 여론을 주권을 대변하는 중요한 역할을 하는 언론이 무관심하고 잘
모른다면...어느누가 이나라의 법치주의 문화를 국제경쟁력있게 창출해 나가겠
는지...
여태껏 외국법이론이나 외국법만을 50여년동안 수입을 해오지 않았는지...
나라의 주인이라면서,잘못 만들어진 법령.자치법이 나라의 주인을 죽이기도 고
통을 주기도,생활비를 더 들게하여 고통스런 짜증나는 한 평생을 살도록 하면서
도,오직 입법권을 가진 자들의 무지와 횡포와 나태함에 4,500만 주인들이 알게
모르게, 법조문으로 국제경쟁력이 떨어지고 행복추구권.인간다운 삶의 질이 저
하되지 않도록 하는 법학방법론은 이나라에서는 없다네.단지 서양 수입법 해석
학만 유일한 법학방법론으로 인정되고,이런 방법론을 터득하여 합격답안작성만
으로 사시합격만 되면,이 나라의 법은 어떻게 만들어지고 고쳐지든,국제경쟁력
있는 입법과 법개정을 위한 우리들 공동체에 알맞는 이론을 가지지 못하고 있다
네.
가장 유일한 입법이론은 단지 과반수 찬성만 있다면...못만드는 법이 어디 있
겠는지...단지 입법권자가 만들었는데... 대충 만들면 되는 것이라고 한다면...
이런식으로 대충 적당히 우선 만들어 보고 누더기 옷이 되든 짜집기를 하든,계
속 고쳐나가면 된다는 방식으로 8만여종의 법을 만들고 고치는 방법으로만 50여
년을 살아왔다면...
이렇듯이 입법방법론에 대한 우리들의 국제경쟁력을 높일 이론을 대학에서 법
학과에서 가르칠 과목과 이론가가 없다면...
우리는 8만여종의 법령조례규칙등이 과연 국제경쟁력있게 우리공동체의 국력강
화와 나라의 주인인 국민들을 골고루 선진국수준으로 잘살게 하는 이상적인 법
인지를 검정하고 대안을 제시할 이론도 정신도 못가진 주인들이라면...
이게 법치주의 국가의 주인의 권리도 의무도 아닐것이라네
이런 한국의 법과대학의 현실이자 우리 대한민국의 현실의 한 부분이다면...그
것을 극복하고,보완하고 우리공동체의 국제경쟁력을 높힐 법학방법론을 발견하
여 보람을 가지고 법학에 한 번 푹 빠져보고 싶다니...나도 법학을 공부하는 입
장에서 보람을 느낀다네...
축하한다네.이것은 법해석학 수험법학만으로 이나라의 법치주의 국가의 8만여
종의 법령,자치법을 만들고 고치고 방치하고,무관심하고 무지한 우리들에게 자
네들의 그 생각은 선진법치주의 국가로 나갈 방법론을 찾았고,우리들 스스로의
힘으로 잘사는 법치주의 국가로 나갈 지혜를 찾았기에 이를 위한 다면,한번이
아니라 평생 푹 빠져볼 법학이 아니겠는지...
딱딱한 형행법조문만을, 그림하나 없이 활자로 설명만하거나, 논리적인 해석
과 귀에 익지않은 법률용어의 나열만으로 연속되는,답안을 작성하기 위한 외우
듯이 이해 해야할 방대한 분량이라고만 생각하기 쉬운데...
부디 자네들의 이런방법의 법학방법론으로 법학공부를 대학생활중에라도 한 번
이라도 빠져보게나...학점은 잘 못나올지 몰라도 언젠가는 이런 방법론으로 무
장된 전문가가 이나라의 법치주의 국가에서는 없어서는 안될 보배로운 법이론가
로 존경되고 필요할 것이라네...
그러나 실정법 해석방법론을 경시해서는 또 현실에 무기력하게 된다네.
실정법해석방법론을 필수적이되 내 강의를 듣고 자네가 발견한 법학방법론 데
로 법학공부방법을 곁들려서 해보기 바라네.
참으로 듣기 좋은,바람직한 생각을, 내 강의를 듣는 자네들의 입으로 듣게 되
어 나는 보람을 느낀다네.
사법시험과목해설과 준비에 온통 이나라의 법과대학은 자신의 역할을 외소하게
만들어 가고 있다네.그런줄도 어쩌면 잘 모른다네...
자네가 말하는 이런 법학방법론 자체가 법과대학에서는 존재하지를 않는현실에
서...전부 서양 수입법의 편집.해석.이론소개등으로 끝나며,그 이상은 드물다
네.
그리고 정작 수입법이론도 수박겉핥기식의 서양법철학.서양법사상.로마법.게르
만법.영미법.독일법의 소개와 역사등을 몇가지 아는게 우리에게 필요는 하겠지
만...그것으로는 결코 오늘의 우리의 현실을 국제경쟁력있는 법치주의 문화로
빠르게 변화시키기에는 역부족이라네.
그런 지식으로 미국보다 수십배나 긴 역사와 다른 문화를 가진 우리 공동체에
서 외국인들의 삶의 정신과 법의 이론과 역사를 수박겉핥기 식으로 50여년을 소
개하고 이들나라로 부터 수입하고 편집하고 번역하고 짜집기 한 법으로만 우리
문화를 고치고 없애고 외국인들의 삶을 수입만 한들...우리가 IMF의 간섭과 도
움을 피할 수는 없는 법치주의 국가였다네...
500년치의 조선왕조와 18 년치의 개화기의 법치주의 국가의 문화를 깡그리 짓밟
고 무시하여 결국 이땅의 우리 국민들의 국제경쟁력을 높힐 입법이론을 법문화
를 전부 일방적인 수입법문화이론으로 다 메꾸어갈려니...
아프리카 오지에 사는 사람들이 미국이나 독일이나 프랑스법만 온통수입해서 선
진국처럼 살아진다고 한다면...그게 얼마나 비용과 부작용이 많겠으며,그들모두
는 거의 대부분은 결국 어느 돈 많은 사람들의 근로자로 전락하되어 고된 삶을,
노예아닌 강제노동을 하지않으면 잘수없는 팔자로 되기 십중팔구이겠지...
우리는 미국역사보다 두배가까이 길거나 앞선 법문화를 가진 법치주의 국가의
후예가 사법시험과목 일색으로 법과대학의 커리큐럼을 만들어 우리조상들의 자
랑스런 법문화를 스스로 짓밟고 ,모르는 것이 잘난것이고,아는 것이 시대에 뒤
떨어진 것이고,우리전통법이론이나 법문화를 연구하면,법학자가 아니며,평생 연
구비 한푼도 지원해 주지 않고,국가도 외면하고,정부도 외면하고,정치가도 잘
모르고,법학자들 스스로도 잘모르고,사시합격자들인 법조인들도 외면한다면...
이나라는 수입법문화로 국제경쟁력을 높이자는 유일한 방법밖에는 없지않는
지...
아프리카 원주민들도 이런 바보짓은 하지 않을 것이 아닌지...
그럼 정작 법문화 선진국에서는 과연 자기네들의 법의 역사를 얼마나 소중히 하고 있는지...다음의 인터넷사이트에서 독일의 프라이부르그 대학의 한 곳만 소개해 본다네.

There is no way of avoiding the fact that China is the central culture of Eastern Asia. Massively larger than any of her neighbors, China may have developed its cultural forms in relative isolation, but since the advent of Buddhism has both absorbed outside influences and disseminated its own culture. Japanese, Korean and Vietnamese cultures are not comprehensible without taking into account power of Chinese culture in art, literature and religion.
Chinese culture itself is highly complex, and the other East Asian cultures also reflect local circumstances and traditions. For instance the (later) Chinese ideal of a scholar-gentleman contrasts strongly with Japanese warrior ideals. It is not going to far to suggest that the very different responses of the various East Asian to the Western intrusion of the past two centuries reflect the variety of previous historical developments.

물권법의 강의를 듣는 자네가 "교수님의 강의를 듣고 있다보면 정말 법학이란
학문이 잼잇게 느껴지고 한번 푹 빠져서 공부해보고 싶은 학문이란 생각이 드네
요...^^"라고 한 말은
이나라 대학의 법학도들의 극 소수가 느낄수 있는 표현이거나 거의 대부분의 학
생들이 할 수 없는 생각을,아니 법학과를 나왔거나 다니는 법과생들의 그 아누
구도 감히 생각해 볼 수도 없는 법학에 대한 재미있는 방법론을 발견한 것일지
도 모른다네
우리 나라 대학의 법과생들의 대부분은 한번쯤은 현행의 사법시험과목속에 들
어 있는 법조문의 해석을 교과서등을 통해서 이해하여 사법시험합격에 큰 목적
을 두는 경우가 대부분이므로,단지 사법시험 합격방법론에 몰입하지 않을 수 없
어서,결국은 법조문을 객관적으로 합리적으로 논리적으로 풀이한 현행 실정법
의 해석학적의 이해와 암기과 합격 답안작성의 실력을 높이는 것이 주목적이므
로,재미있는 학문으로 한 번 푹 빠져서 공부해보고 싶다니...진짜 법학방법론
을 자네는 발견한 것이라네.
아니 사법시험 합격자를 많이내는 대학일 수록 상상을 할 수도 없는 법학방법론
을 넓히는, 보완하는 우리공동체의 법치주의 문화의 국제경쟁력을 높일 소중한,
온 국민들의 삶을 법으로 구제할 방법론을 자네가 알게 되어 스스로 말하는 것
이라네...
우리 공동체의 법문화를 발전시키고 국제경쟁력을 높힐려면,누가 어떤 법을 어
떻게 만들어 놓든,해석만 논리적이고 객관적이고 합리적으로 하면,법치주의국가
의 국제경쟁력이 생기고,잘살게 될것이라고 다들 그렇게 알고 믿고 살고 있다
네...
국제경쟁력있는 법을 만들어야 하고 시대에 맞지 않는 법을 시급히 잘 고쳐야
하고,이를 국력강화와 국민들이 삶의 질의 향상을 위해 현실에 맞게 해석해야
하고,이를 공정하게 의지를 가지고 잘 집행해야 국제경쟁력있는 잘 사는 법치주
의 국가가 될 것이라네...
그런데 우리나라의 대학에서 어느 법과에서 사법시험을 목표로한 법해석학적 방
법이외에 국제경쟁력있는 법을 만들어야 된다며,국민들의 삶의 질의 저하시키
는 법령,자치법을 시급히 잘 고쳐야 한다는 입법이론을 강의해주는 곳이 없다
네.
왜냐하면,법과대학에서는 사법시험 합격만 많이 시키면 그것으로 법학의 목적
과 법과대학의 목적이 끝난줄로 착각하고 만족하고 살아온 셈이라네.그래서 사
시합격이외의 법학방법론은 생각할수도 꿈도 꿀수도 없는 수험법학을 50여년간
해 왔고 앞으로도 별 변화가 없다면,그렇게 갈려고 할 것이라네...
이나라에서 해방후 지금껏 만들어 지고 고쳐지고 있는 8만여종의 법령.조례.규
칙들은 국민들도 그 법령의 내용은 고사하고 그 이름도 잘모르는 사이에 국회의
원들이나 행정부 공무원들이나 자치단체의 입법권자들의 손에 의해 수많은 변화
를 하고 있지만.그 법령,자치법규들이 정말 국제경쟁력이 나게 우리 공동체
에 알맞게 만들어 진것인지...만들어 지도록 심혈을 기울렸다고 생각할 수 있
는 법이 8만여 종류중에 과연 몇%나 될른지...
아니 우리에게 맞지않고 생활비만 많이들고,불편하고 나라와 사회와 국민들의
국제경쟁력을 떨어뜨리는 법조문은 몇개나 만들어 졌으며...왜 만들어지고,왜
시급히 고쳐지지 않는 것인지...이를 시급히 해결하고 대안이나 이론을 제시할
법이론이 우리공동체에서는 존재하지 않거나.존재하도록 꿈도 꾸지 않고 있는
자유민주 복지를 향한 대한민국이라는 법치주의 국가라네.
이렇게 만들어진 법은 우리국민 4천5백만 한사람 한사람에게 평생 태어나서 죽
을때까지 함께 그림자 처럼 따라다니며,부모님의 말씀보다 더 강하게,마피아나
폭력집단의 위력보다 더 강하게,군대보다 더 강하게 시시각각 우리들의 삶의 구
석구석을 현실적으로 지배하고 강제하고 온 인생전체를 억누르며 생각과 행동
을 합법적이지 않으면 위법하여 형벌이나 재산적 피해를 받게 해 가고 있다네.
비전문가들이나 대충.얼렁뚱땅 경쟁력없는 우리들의 삶의 발목을 잡는 불합리
하거나 경쟁력을 죽이는 삶의 질을 낮추는 짜증나는 법조문들이,입법권한을 가
진자의 민주적인 절차(합법적.다수결)에 의했다는 형식논리에 우리는 눈이 어두
워 그냥 금과옥조로 지켜야 한다고만 생각하고 복종하지 않을 수가 없는 법치
주의국가라네...
그 먼 미국이나 독일이나 프랑스나 선진외국의 법이론이나 그들의 수백년 천년
도 넘는 법역사를 예를들필요 없이,이땅위에서 한 나라를 세워서 500여년간이
나 법치주의 문화를 꽃피운 우리 조상들이 삶을 조선왕조실록을 통해서 살펴보
면,법은 백성들에게 불편하지 않고 백성들이 잘 살수 있게 하기 위해서 시대
와 환경에 맞는 이상적이 자손만대로 오래갈 법을 만들어야 한다는 이론이 입법
이론의 가장 중요한 많이 주장한 이론으로00여년간 법을 만들고 고쳤다고 실록
에 기록되어 있다면...(사법행정에 발표하였음)
우리는 오늘날 찬반양론이 팽팽한 국민들의 민원과 고통과 삶의 질을 낮추고 짜
증나게 하고 결국은 국가의재정과 국민들의 생활비를 더 낭비시키며 국가경쟁력
을 떨어뜨릴 법이라도,아니 전 국민들의 삶의 불편하고 인간다운 삶과 행복추구
권에서 더 멀어져가고,실질 소득이 더 감소되고,국력이 낭비되더라도,무조건 과
반수면 민주적이고,합법적이고 정의라며, 반대의사보다 한 명만 더 찬성하면 통
과된다라는 법이론이 과연 우리조상들에 입법이론에 부끄럼이 없는,진정으로 백
성들을 잘살게 하고 지키기 편리한 민주적인 법이라고 부끄럼없이 말 할 수 있
겠는지...
급하다고 얼렁뚱땅 보기좋게 수입하여 편집하고 짜집기하고,비전문가들의 오래
고 깊은 연구와 현실적인 현장조사도 없이 ,주마간산 식으로 만들고 고치기 시
작한다면...
그 법도 과반수 찬성이란 형식적인 숫자놀이로 실은 입법권자라는 주권을 위임
받는 입법권자의 국민의 신뢰를 배신한 행위로 만든 법이라도 민주주의 국가의
국민이 만든법이라며 스스로 지켜야 하는 우리네의 민주주의 국가의 입법이론
이 아닌지...
우리나라에서 법학이라는 학문은 대학에서는 사법시험합격에 눈이 어두워 시험
과목 해석과 답안작성 수준에만 정신이 다빼앗기는 사이에... 이런 불편함과 법
치주의 국가의 발전을 저하할수 있는 국제경쟁력없는 법을 마구잡이로 즉흥적으
로 몇몇이 비전문가들이,입법권을 위임받는 권한을 행사한다면... 적당히 만들
어 나가거나 고쳐 나간다면...아니 잘못된 시대에 맞지않는 법이 시급해 고쳐지
지 않는다면,,,아니 개선이 되기보다 개악이 되는 경우도 생긴다면...
우리는 언제 국제경쟁력있는 잘사는 나라나 국민들이 될수 있겠는지...그동안
의 숱한 정신적 물질적 삶의 질의 저하와 국력이 약화되고 개인의 삶이 찌들어
가는 인간다운 삶이 ,자유.민주.복지의 공동체는 언제 만들어 질른지..
그리고 모신문사에서는 법과를 평가한다면서 결국은 사법시험 합격자를 많이
배출한 법학과가 가장 좋은 법과로 평가를 하고 있다면...이나라에서 법학이란
학문이나,대학의 법학과가 할 수 있는 것이란 사법시험 합격을 위한 것 이외
는 더 연구할 필요가 더 무엇이 있겠는지...
IMF예방법이나 극복법이 신속히 잘 만들어 지지 않는데는 법학이 전혀 무관하다
면..이나라가 법치주의로 민주주의로 복지국가로 어떻게 나갈 수 있는지...
그리고 법으로 4,500만 나라의 주인의 삶을 온통 평생 좌지우지 하면서도, 국제
경쟁력있는 우리에게 알맞는 이상적인 법이 신속이 잘만들어 지거나 신속히 잘
고쳐지는데 이나라의 법과대학이 무관심하거나,이론제시를 못하거나,가르쳐 주
지않는다면...이나라 주인들은 어디에서 경쟁력있는 입법이론을 배울것인지...
아니 국민의 여론을 주권을 대변하는 중요한 역할을 하는 언론이 무관심하고 잘
모른다면...어느누가 이나라의 법치주의 문화를 국제경쟁력있게 창출해 나가겠
는지...
여태껏 외국법이론이나 외국법만을 50여년동안 수입을 해오지 않았는지...
나라의 주인이라면서,잘못 만들어진 법령.자치법이 나라의 주인을 죽이기도 고
통을 주기도,생활비를 더 들게하여 고통스런 짜증나는 한 평생을 살도록 하면서
도,오직 입법권을 가진 자들의 무지와 횡포와 나태함에 4,500만 주인들이 알게
모르게, 법조문으로 국제경쟁력이 떨어지고 행복추구권.인간다운 삶의 질이 저
하되지 않도록 하는 법학방법론은 이나라에서는 없다네.단지 서양 수입법 해석
학만 유일한 법학방법론으로 인정되고,이런 방법론을 터득하여 합격답안작성만
으로 사시합격만 되면,이 나라의 법은 어떻게 만들어지고 고쳐지든,국제경쟁력
있는 입법과 법개정을 위한 우리들 공동체에 알맞는 이론을 가지지 못하고 있다
네.
가장 유일한 입법이론은 단지 과반수 찬성만 있다면...못만드는 법이 어디 있
겠는지...단지 입법권자가 만들었는데... 대충 만들면 되는 것이라고 한다면...
이런식으로 대충 적당히 우선 만들어 보고 누더기 옷이 되든 짜집기를 하든,계
속 고쳐나가면 된다는 방식으로 8만여종의 법을 만들고 고치는 방법으로만 50여
년을 살아왔다면...
이렇듯이 입법방법론에 대한 우리들의 국제경쟁력을 높일 이론을 대학에서 법
학과에서 가르칠 과목과 이론가가 없다면...
우리는 8만여종의 법령조례규칙등이 과연 국제경쟁력있게 우리공동체의 국력강
화와 나라의 주인인 국민들을 골고루 선진국수준으로 잘살게 하는 이상적인 법
인지를 검정하고 대안을 제시할 이론도 정신도 못가진 주인들이라면...
이게 법치주의 국가의 주인의 권리도 의무도 아닐것이라네
이런 한국의 법과대학의 현실이자 우리 대한민국의 현실의 한 부분이다면...그
것을 극복하고,보완하고 우리공동체의 국제경쟁력을 높힐 법학방법론을 발견하
여 보람을 가지고 법학에 한 번 푹 빠져보고 싶다니...나도 법학을 공부하는 입
장에서 보람을 느낀다네...
축하한다네.이것은 법해석학 수험법학만으로 이나라의 법치주의 국가의 8만여
종의 법령,자치법을 만들고 고치고 방치하고,무관심하고 무지한 우리들에게 자
네들의 그 생각은 선진법치주의 국가로 나갈 방법론을 찾았고,우리들 스스로의
힘으로 잘사는 법치주의 국가로 나갈 지혜를 찾았기에 이를 위한 다면,한번이
아니라 평생 푹 빠져볼 법학이 아니겠는지...
딱딱한 형행법조문만을, 그림하나 없이 활자로 설명만하거나, 논리적인 해석
과 귀에 익지않은 법률용어의 나열만으로 연속되는,답안을 작성하기 위한 외우
듯이 이해 해야할 방대한 분량이라고만 생각하기 쉬운데...
부디 자네들의 이런방법의 법학방법론으로 법학공부를 대학생활중에라도 한 번
이라도 빠져보게나...학점은 잘 못나올지 몰라도 언젠가는 이런 방법론으로 무
장된 전문가가 이나라의 법치주의 국가에서는 없어서는 안될 보배로운 법이론가
로 존경되고 필요할 것이라네...
그러나 실정법 해석방법론을 경시해서는 또 현실에 무기력하게 된다네.
실정법해석방법론을 필수적이되 내 강의를 듣고 자네가 발견한 법학방법론 데
로 법학공부방법을 곁들려서 해보기 바라네.
참으로 듣기 좋은,바람직한 생각을, 내 강의를 듣는 자네들의 입으로 듣게 되
어 나는 보람을 느낀다네.
사법시험과목해설과 준비에 온통 이나라의 법과대학은 자신의 역할을 외소하게
만들어 가고 있다네.그런줄도 어쩌면 잘 모른다네...
자네가 말하는 이런 법학방법론 자체가 법과대학에서는 존재하지를 않는현실에
서...전부 서양 수입법의 편집.해석.이론소개등으로 끝나며,그 이상은 드물다
네.
그리고 정작 수입법이론도 수박겉핥기식의 서양법철학.서양법사상.로마법.게르
만법.영미법.독일법의 소개와 역사등을 몇가지 아는게 우리에게 필요는 하겠지
만...그것으로는 결코 오늘의 우리의 현실을 국제경쟁력있는 법치주의 문화로
빠르게 변화시키기에는 역부족이라네.
그런 지식으로 미국보다 수십배나 긴 역사와 다른 문화를 가진 우리 공동체에
서 외국인들의 삶의 정신과 법의 이론과 역사를 수박겉핥기 식으로 50여년을 소
개하고 이들나라로 부터 수입하고 편집하고 번역하고 짜집기 한 법으로만 우리
문화를 고치고 없애고 외국인들의 삶을 수입만 한들...우리가 IMF의 간섭과 도
움을 피할 수는 없는 법치주의 국가였다네...
500년치의 조선왕조와 18 년치의 개화기의 법치주의 국가의 문화를 깡그리 짓밟
고 무시하여 결국 이땅의 우리 국민들의 국제경쟁력을 높힐 입법이론을 법문화
를 전부 일방적인 수입법문화이론으로 다 메꾸어갈려니...
아프리카 오지에 사는 사람들이 미국이나 독일이나 프랑스법만 온통수입해서 선
진국처럼 살아진다고 한다면...그게 얼마나 비용과 부작용이 많겠으며,그들모두
는 거의 대부분은 결국 어느 돈 많은 사람들의 근로자로 전락하되어 고된 삶을,
노예아닌 강제노동을 하지않으면 잘수없는 팔자로 되기 십중팔구이겠지...
우리는 미국역사보다 두배가까이 길거나 앞선 법문화를 가진 법치주의 국가의
후예가 사법시험과목 일색으로 법과대학의 커리큐럼을 만들어 우리조상들의 자
랑스런 법문화를 스스로 짓밟고 ,모르는 것이 잘난것이고,아는 것이 시대에 뒤
떨어진 것이고,우리전통법이론이나 법문화를 연구하면,법학자가 아니며,평생 연
구비 한푼도 지원해 주지 않고,국가도 외면하고,정부도 외면하고,정치가도 잘
모르고,법학자들 스스로도 잘모르고,사시합격자들인 법조인들도 외면한다면...
이나라는 수입법문화로 국제경쟁력을 높이자는 유일한 방법밖에는 없지않는
지...
아프리카 원주민들도 이런 바보짓은 하지 않을 것이 아닌지...
그럼 정작 법문화 선진국에서는 과연 자기네들의 법의 역사를 얼마나 소중히 하고 있는지...다음의 인터넷사이트에서 독일의 프라이부르그 대학의 한 곳만 소개해 본다네.

There is no way of avoiding the fact that China is the central culture of Eastern Asia. Massively larger than any of her neighbors, China may have developed its cultural forms in relative isolation, but since the advent of Buddhism has both absorbed outside influences and disseminated its own culture. Japanese, Korean and Vietnamese cultures are not comprehensible without taking into account power of Chinese culture in art, literature and religion.
Chinese culture itself is highly complex, and the other East Asian cultures also reflect local circumstances and traditions. For instance the (later) Chinese ideal of a scholar-gentleman contrasts strongly with Japanese warrior ideals. It is not going to far to suggest that the very different responses of the various East Asian to the Western intrusion of the past two centuries reflect the variety of previous historical developments.
